Legal Question in Consumer Law in California

HI,

I signed a contract for advertising services with no contract end date, or use by date. When the contract was purchased they gave me net30 terms and fees started to accumulate if they were not paid within those 30 days. since then the company in which I signed the contract with is killing that division of the company and we mutually ended the contract and they agreed to refund my money. It has been 2 months and still have not received the refund amount. I was approaching the date in which the advertising would have been used and still did not receive it so that I could purchase more advertising. Now my business launch is on hold until I get that money. My question is, can I collect damages on them not returning my money in the same time frame that they demanded payment? My business is now being delayed because of this and I reasonably expected them to deliver the money in the same timeframe.

if you mean damages for loss of business, the answer is no unless the contractor specifically allows this type of claim. You would be limited to a refund of your money.
