Legal Question in Consumer Law in California
Hi,
My name is J. and I have a question:
- I have purchase some fitness DVDs (name: P90X) online from China hopping to make a little profit on eBay, so I sold 5 to 6 sets last month.......and last Saturday I got a letter from what I think is low firm JOHNSON & PHAM, LLP for a "payment of $893.16 within 10 days based on my profits and product partners attorneys fees and investigative costs related to my unauthorized sale and distribution of infringing merchandise
Please what is the right thing to do, knowing that I purchase those DVDs as originals not as a copy?
Thanks

You bought illegal copies of copyrighted CDs, and then you tried to resell them. No reasonable person would believe that copyrighted CDs purchased from China are legitimate. Pay them.
Mr. Stone is correct that you may well have been in copyright violation, and you should consider stopping your practice.
On the other hand, this letter sounds like a scam. I would be happy to review that letter for you. If you would like me to do so, please call my office and arrange to fax or email it to me.
If they were authorized copies, you should be able to prove it. So prove it.
