Legal Question in Consumer Law in California

Horse Purchase

My wife purchased a horse for the sum of $4,000 from a gentlemen who stated that if the horse did not work out he would refund the money. There was no contract, everything was verbal. After two weeks, she tried to return the horse.

The gentlemen for the next two months said he would refund our money, but never did. Finally he told us to sell the horse beacuse he could not come up with money. This gentlemen still holds the papers to the horse because he never sent them to us. He is now claiming that we owe him $3,000 more for the horse, and that if we don't pay him he will sue us. We don't understand where this extra $3,000 came from. What are the laws behind this type of purchase without a contract ? The only documentation we have is the $4,000 check he cashed of ours.

Please help!!!!!

There does not appear to be evidence of a contract that would allow for refund or a higher price. Therefore, you have the horse and he has the $4,000.00 and is not entitled to more.

This sounds like the seller is trying to get out of giving you back your money. Stop wasting time and sue in small claims court ASAP.
