Legal Question in Consumer Law in California
Does a hotel have to honor a price quoted on the telephone by an employee after the employee has just been fired? I called for a block of 25 rooms and they quoted me $109/$119. I waited for the agreement and it never came, so I called the hotel and they said my contact no longer worked there. I was forwarded to a sales manager who told me the person should have never quoted me that rate and the best she can do is $149. Am I out of luck because I never received the original agreement?

You could theoretically pay the $149 and then take them to small claims court for $1000/750 per day. But, of course, it would be your word against theirs. Good luck locating and serving a subpoena on the former hotel employee. You would also have great difficulty proving you reserved the lower rate without a confirming fax, or at least a confirmation number.
