Legal Question in Consumer Law in California

Internet Auction Fraud

I made the winning bid on a poplular auction site for a camcorder - $480. I received an email from the seller giving me instructions on payment and shipping ($20). I used an email payment service to send him a total of $500. I never received the merchandise. I filed a claim with the email payment service and they indicated because the seller was not a ''verified'' seller, my claim was denied. They refuse to disclose this seller's personal information because of their privacy policy. What can I do to press charges against this individual if I don't know who it is? Can I sue this email payment service to disclose his information or would I be able to file a small claims against this email payment service for my loss? Please advise. Thank you.

Re: Internet Auction Fraud

I don't see how you have a claim against the e-mail service. However, I suppose you could file a lawsuit against the seller and subpoena the records from the e-mail service in order to get the seller's identity.
