Legal Question in Consumer Law in California

LA Fitness

My Son is 16 and gave LA Fitness $80.00 thinking that would cover 2 full months of service...he signed some sort of an agreement. I received a call from a membership rep today wanting my credit card info....she said the 80 dollars was for first and last payment and they want to chage me 39.99 per month. I told her i would not give it to her and explained that Justin is only 16 and cannot legally sign any contracts....she said it wasnt a contract it was an agreement. I told her i wanted Justin's money back and she said he cant have it back....is this legal?? can a 16 year old sign an agreement and can they keep his money?? Thank you for your time in advance.

An agreement is a contract. Speak to their home office or owner.

Ask to speak to a manager and politely request the refund. Have your son send a letter (certified mail, return receipt requested) that says he's sixteen years old and that he has elected to void and/or rescind the contract - effective immediately. Include a request that they send his refund to [insert address].

Get the name of the person in charge of that location and send to his attention. At the bottom of the letter, put "CC: L.A. Fitness District Manager, Regional Manager, Corporate Office"

You don't have to actually send those people a copy, but it should make the people at your club a little nervous.
