Legal Question in Consumer Law in California
Legal recourse for misuse of pictures
I had a laser hair removal treatment at a big medical clinic about 2 yrs ago. The medical clinic has used pictures (before and after) of mine for advertising on their website without my consent. I am very upset that they have my pictures on their web site without my consent and was I wondering what my legal options are.

Re: Legal recourse for misuse of pictures
First, review your agreement carefully to ensure that they did not sneak a provision in the treatment agreement that allows them to use your image. If not, you would definitely have a valid claim for at minimum, invasion of privacy (public disclosure of private facts and misappropriation of likeness). Google California Civil Code section 3344 for the statutory basis. Feel free to contact me to discuss, I would be happy to walk you through the process and your options.
