Legal Question in Consumer Law in California
Lemon Law
I purchased a New 01 Nissan Altima GXE in September 2001. Shortly there after I started to notice a loud crunching/rattling noise coming from my car suspension from front and rear. While driving over the slightest bumps. It has been taken to 2 Nissan authorized dealers for repair totaling at least 9 times. They claim to have fixed the problem but it still remains. I have written to Nissan consumer dept but they basically are no help. They dont respond to my letters and or calls. I am basically left out in the cold. I want to know if suspension problems qualify for the lemon law. My car currently has 6,800 miles. I am scheduled to take the car back again but I am wondering if I should. Since they have not been able to fixed it the past 9 times. What can I do? Nissan headquaters does not care about my complaints.

Re: Lemon Law
Sounds like a Lemon to me. If the suspension is under warranty, and there are less than 18,000 miles on the car and it is less than 18 months old, and it is for personal use, it sounds as if you qualify.
Civil Code 1790, and those immediately following are the codes to cite.
