Lowes not covering repair under warranty

I bought a home from Kevin, Kevin installed laminate flooring 8/01 1 year warranty. I looked at home on 3/02.

condition of purchase to fix flooring. Kevin called Lowes 4/02. Lowes says no prob we wil fix it under warranty. have a fax from them dated 6/02. they send person out 3 times, and keep giving excuses for almost a year. now they say it's not under warranty because of ownership change. I bought place in July. They backed out because it was an installation error and will cost $6500. They installed it?

If I go to small claims and ask for $5k, do ''I'' take them to court or ''Kevin and I''? alternative to small claims? help

since you are kevin's successor in interest, you would have the same rights as kevin would have against lowes in this matter, absent any contractual warranty provision to the contrary stating kevin only had standing to sue. let me know what the contract and/or warranty reads in respect to the purchase order, and i may be able to assist you further legally. also, your alternative to small claims court would be having an attorney helping you with writing a demand letter to lowes on your behalf, which could bring quick closure to this situation in your favor.
