Legal Question in Consumer Law in California
Manufacturer Bankrupt - have 3 yr extended warranty from another company.
I received a Quantex Computer in June 2000. During that same month, I purchased a 3 yr. on site extended warranty from Quantex. The invoice clearly states that the warranty service is provided by Philips-Magnavox. Quantex went bankrupt in Oct 2000. My computer monitor now needs repair, so I called Philips-Magnavox. They refused service because they say that because a year has not passed, it is still under manufacturer warranty. When I ask the Philips service representative if I was suppose to wait until June 2001 to request service, she said that they still wouldn't service it, because it would be a pre existing condition that should have been serviced by the manufacturer. Even though that is an impossibility because the manufacturer is bankrupt and doesn't exist. Do I have any recourse?

Probably not. You need to read the exact terms of the warranty. Perhaps if you're lucky, the problem will fix itself and then suddenly becoming "new" problem in June.

Read the terms of the extended warrenty closely in regards to what's covered and what's not. It must have a specific exclusion for "prexisting problems" or "problems which arose before the etetended warranty took effect" or similar language for them to escape responsibility. Unfortuantely, I doubt you can wait until June for a new monitor anyway. Check and see who the monitor was actually manufactured by and contact them to see whether they will accept responsibility or at least give you a good deal on a replacement.
