Legal Question in Consumer Law in California

Mechanic didn't do his job, but billed me anyway...

I just got my motorcycle back after it's 10k tuneup to discover that the engine is not tuned properly and constantly stalls, they didn't check the brakes or fluids, and they didn't check or adjust the clutch and fluid. I paid a $709.00 bill and was given a dangerous motorcycle with a list of all the checks they supposedly performed on the bike. Now I don't trust them to do the job properly if I take it back. I want to take it to another mechanic and then send the bill to the first mechanic with a detailed list of all the work done. I'm expecting a fight. Are my actions in the wrong? Any advice greatly appreciated.

If you did not pay the first mechanic, you cannot make him pay the second mechanic. Your remedy is that you do not have to pay the first mechanic and you consider the first mechanic for the second mechanic spill over and above what the first mechanic quoted you. If you didn�t pay a first mechanic, then you consider the first mechanic for what it cost you to have the second mechanic fix it.If you are expecting a fight, has a second mechanic take pictures and document the condition of the car when he does the work.
