Legal Question in Consumer Law in California
Medical Supply Company Threatening to pick up equipment
My husband is on oxygen at night and during the day. He has been on Medi-Cal since April 2002. He gave the Tech a copy of his Medi-Cal card in May on 2002. The Medical Supply company instead tried to bill Blue Cross, which he had before Medi-Cal. They since realized that they needed to bill Medi-Cal, but because it has been so long they are having a problem getting paid. It is not our fault they messed up on their billing, I don't feel they have a right to call my husband and stress him out threatening to pick up the equipment. They called one day and said they were on the way to pick it up, and I told them no way, if my husband ends up in the hospital because of that, I would hold them liable. I don't want to see my husband not being able to breathe and going to the hospital, what can we do? He is on SSI and Medi-Cal and in July will be on Medicare. We don't have the money to pay for equipment that is covered my Medi-Cal, but was billed incorrectly.
