Merchandise return or refund purchase price

I purchased a gauge set for my classic chevy show car from a small private company in California in late June '04'. The gauge set had a faulty reading fuel gauge. I contacted the company to try and resolve by phone. The company told me to return the gauges in mid September so they could re-calibrate the fuel gauge. As of today (11/16/04) I have still not recieved my gauges. I've left several voice mail messages and e-mail messages with the company asking for either the return of my gauge set or the refund of my purchase price (approx. $700.00) and have had no response. My question is what legal recourse do I have being a resident of Texas and the company refusing to return my merchandise or refund my money being located in California?

The short answer is that you can sue them. The "where" would be determined by all the facts to see if you need a California attorney, or can sue them in Texas.

But before you do that, send a letter to them by certified mail demanding either properly calibrated gauges or return of your money, and demand an explanation as to why they haven't responded to your earlier requests. Don't rely on the telephone or email for that.
