merchant oversold product

I purchased an item via telephone - total value of item

plus all accessories was $3,000

I was given a purchase order number, and my credit

card was charged

The merchant oversold the item, and may not be able to

fullfill my order, which I want.

Is the merchant required to provide me with a

comparable item at the same price?

All transactions were done in California

He is not required to but can if there is a written or oral statement by him. Best be is to cancel contact, get money back and try another merchant.
