Legal Question in Consumer Law in California
Messed up transmission
I took my car to do the 90,000 revision. When the car was ready, it would not move forward. They offer to take the car to their body shop, where they found out that there was a pre-existing problem with the transmission. Since the car entered their business ''running'' and had to leave their business in a tow car do I have any chance to get ANY money back for my expanses? I contacted the district manager for the business, and he said he would pay me nothing since the body shop stated that it was a pre-existing problem. Please give me a little help here...

Re: Messed up transmission
You can't recover anything unless you are able to prove that the service shop caused the problem with your transmission. Have a mechanic look at the vehicle and see if it can be determined what caused the problem with your transmission. It could simply be an unfortunate coincidence maybe it was damaged by the ship. There might be some other cause, but you need to find out the facts before you can hold anybody accountable.
Re: Messed up transmission
There is a good chance that this auto repair service is simply trying to deny and avoid liability period. We all know how "honest" such businesses are alot of times. Further, if your vehicle left the shop in worse condition than it entered, the burden of proof could easily shift to the shop once you have asserted your facts in the case. You should DEFINITELY consult with an attorney on this if you are very serious about your claims herein. For a free consultation, contact us directly.
