Legal Question in Consumer Law in California
Misrepresentation of Work At Home Opportunity
I recently bought into a ''Work At Home'' opportunity. I saw an advertisement that led me to believe that this firm was looking for Data Entry personnel to fill out their forms and mail them. I sent them the upfront ''good faith & sincerity deposit''. Upon receiving the material I realized this was not an offer of employment at all, but instructions on how to start my own business, which would require, at my own expense and time, create, promote and advertise and secure my own clients. I was led to believe that I would be processing forms using the information that they would provide, on a per case basis. I immediately emailed and sent by certified mail a request for a refund, but I haven't received any response. I have discovered that the practices performed by this firm have misled a number of individuals, and this firm is also negatively listed by the BBB, and it is their opinion that this company does misrepresent their offer. I want to take them to small claims, but I also want to inform the D.A. for possible prosecution under several statutes of California Code & US Code. What are my moves and what would be the timely strategy?
