Legal Question in Consumer Law in California
My mother's home in the Del Webb community of Sun City Summerlin in North Las Vegas, NV is selling and currently in escrow. There is a large crack in the front corner of the garage floor slab that seems to be caused by tree roots from a tree in the common area in fron of her home. The tree was planted by Del Webb but the current homeowner's association in charge of maintaining that (common) area has been watering it since long before my mother purchased the home. The current issue with the buyers is that the concrete needs to be repaired. The H.O.A. says it's my mother's responsability, because they don't maintain the interior garage, and because they did not plant the tree. I maintain that they (the H.O.A.) watered the tree which caused it to grow to the point of lifting the concrete, so they are responbible. Am I wrong? Who should be responsible for something like this?
