Legal Question in Consumer Law in California

Negligence or compromising information?

A computer company took my laptop in for repairs. They returned it to me and claimed they cleared my hard drive. Someone called me from across the nation that also had repairs done. They said when they got their laptop back it had my personal information in it. All my files, pictures, documents, and saved passwords. I fee like there was negligence and compromising of my personal information from this company. I spent hours canceling stock , bank, and credit card accounts and also changing passwords. Can I take any legal action for the stress and time this has caused. And if so how should I go about doing so?

I don't know whether your damages would make it worthwhile to sue (also whether the weasel-wording on your repair contract - did you read it? will hold up in court). Please tell InfoWorld consumer editor Ed Foster about your experience at gripe2ed.com . Of course, if you were to pursue this legally, you would want to use a licensed California attorney.

Re: Negligence or compromising information?

You have damages. Calculate a reasonable rate for your time and multiply it by the number of hours you spent. This is probably a small claims court matter as it is probably under $7,500 in damages.
