my neibors tree is so big that its pushing my fence over and growing into my house .whos supposed to pay for the tree to be removed ?

That's a difficult question. Typically, one neighbor cannot harm another person's property with their trees. The injured party may legally remove parts of the tree that damage that person's property, but the ijured party cannot kill the tree. For your situation, you may ask if there is a community police arbitration type program.
