Legal Question in Consumer Law in California
Non-refundable Deposits
A few months ago while attending a home show my husband and I put a
deposit down on home remodeling supplies in order to ''secure the special
show price.'' Before we put the deposit down we asked the sales girl several
times if it was refundable and she said it was. However, on their sales slip it
states that merchandise is non-returnable and/or refundable. When we went
to get our deposit back we were told that because they had ordered the
merchandise for us (even though we had never selected any specific model of
fixtures or given them a date for delivery) that we could neither have our
money back nor store credit. What legal recourses do I have if any? Can I go
to the credit card company and reverse the charges since I never received any
goods or services? Thank you in advance for your response.

Re: Non-refundable Deposits
More than likely, you ARE entitled to a refund of that deposit. This question was posted long ago and I'm sorry I didn't see it sooner. How much did you put down? Email me to discuss. [email protected]

Re: Non-refundable Deposits
The written sales slip is what is legally binding, not whatever you were told. I suppose you could dispute this with the credit card company, but you deserve to lose.
