Legal Question in Consumer Law in California

I ordered carpeting signed contract , paid down payment by check 8-16-14. 3 days have passed . just found out that carpet will not be available until after 8-10-14 can I cancel order

If you paid the down payment, signed a contract where delivery at a specific time was a condition to the contract, if that condition has not been met then you can cancel the contract in most cases.
