Legal Question in Consumer Law in California
We paid an attorney 3k to modify our loan last year in June or July. Our contract stated that he was not able modify our loan, he would refund 100% of our 3k fee. They were unable to modify our loan and he stated he would "absolutely" refund our money. I spoke to him for the first time the first week of November. He stated we would receive our money in 2 weeks because that's how long it took to process our refund. We are now in the 2nd week of Jan and still no money. What can/should we do?

Send him a certified return receipt letter (keep a copy), demanding payment by a date you specify. If you don't receive the money by that date, you may sue in small claims court and you may file a complaint with the State Bar of California for unethical conduct.
