Must I pay this AT&T bill?

Hi

I signed up for AT&T DSL service & almost immediately had problems. I wrote

repeatedly (because no supervisory staff was available-ever!). i received no

replies until after I cancelled.

Their service was terrible & i was lied to about important aspects of their

service at the time of the original sale.

It took me 40 days to finally give up & cancel. I had 29 in the ''trial period''.

They've slapped me with a penalty charge.

Since their service was uniformly awful, I don't feel it fair to have to pay their

bill.

Can I sue them in court in order to keep that black mark off my credit report?

The early cancellation fee is probably illegal as an unreasonable liquidated damages charge. And if the services were terrible, you should not be required to pay for them.
