Legal Question in Consumer Law in California

Do I have to pay for auto shop's mistakes?

My boyfriend and I took his 1996 Mustang to a shop for a smog. The shop called and said it didn't pass and that they would do a diagnostic on it to figure outwhat the problem was and they would call us back in 30 min., we gave them verbal consent to do this. The car has been in the shop for about five days now, they have not told us any definite problems but have started pulling sensors out of the engine without our consent. We've asked for estimates of work done and they said they couldn't give us one. They then called us and said that while trying to pull a sensor out of the manifold, they cracked the manifold.. so the car does not run at all now. They said they were not responsible for fixing the manifold that they cracked since Ford designed them poorly and are trying to charge us. Is this legal? If they broke something that was in perfect condition when we brought it in, should we have to pay for it, regardless of the manufactuars design?

Call California Consumer Affairs, Department of Automotive Repair and file complaint. This is very helpful.

Sue them in small claims court. Also notify the BAR and file a complaint.
