Legal Question in Consumer Law in California

Personal items in storage under Parents control

My husband allowed his parents to move his possessions from his apartment to a storage unit (before we were married) which they did not give him access to and now he cannot get his possessions because he is not named in the rental agreement and does not have a key, etc. Is there any legal way to transfer the contract into his name and get the lock changed and take control of the contents without his parents permission. He is 35 years old. If we cotact the storage unit we are afraid his parents will dispose of or sell his possessions without his permission.

Re: Personal items in storage under Parents control

Short of going to court against the parents and the storage facility, you can't force the storage facility to turn over control fo the property to your husband and/or assume the contract. The storage facility has no idea who the property belongs to, so you can't put them in the middle.

Why can't your husband ask his parents for his property back?

Re: Personal items in storage under Parents control

Lurking behind this seemingly legal problem, it seems to me, is a mother-in-law vs. daughter-in-law conflict. She (his mother) does not want to let him go. Unfortunately, we lawyers are poor solvers of this type of problem. You may wish to consult a licensed marriage, family and child counselor, either with your husband or by yourself, especially if he can't or won't stand up to his Mom.
