Legal Question in Consumer Law in California
Phone card scammed
I was solicited over the phone by a company to recieve a trial phone card to try risk free for seven days, for the price of $3.95. The company charged the $3.95, but never sent the phone card. The company then proceeded to charge my account $149.90 as a set up charge for the phone card I never recieved. This caused service fees and overdraft charges totaling over $300.00 at my bank. I tried phone calls to the company and filed a report with the L.A branch of the BBB, but still have found no resolution. What are my rights and what should I do to see that they are upheld?

Re: Phone card scammed
Don't use bank debit cards for stuff like this. Use a credit card instead, you then have the legal right to dispute the charge with the credit card issuer. Nevertheless, I would complain like hell to the bank. Put everything in writing. You might also try writing to the California Attorney General's office if the scam operator is in California.
