where is the point of sale?

i recently bought a car part from a company in california (where i also live). the part was described in writing as "good from top to bottom". but arrived with holes, repairs, and cracks. he has refused to refund my money, and i am over 500 miles from him. since the state requires him to collect sales tax for my county- is the point of sale my house/county? can i take him to small claims in my county? or must i do it in his county?

You could make an arguement either way. try filing in your area and see if the court will take it.
