post dated checks
I recently purchase a vehicle from a dealership in
California. I and the dealership signed a HOLD
CHECK(S) AND/OR THIRD PARTY CHECKWRITER AGREEMENT on
4/18.
I agreed to pay $1000 on that day and another $500 on
May 8th. They asked me to post date it and would not
deposit it until that day or the day after. They
deposited it 4/18, which brought my account overdrawn.
Which then caused other things to bounce and my bank
charged me $90 in insufficient fund fees.
What kind of recourse do I have? I am trying to get
them to pay the $90 at least and they are

You might consider suing them in small claims court for the $90.00. Your chances of success would depend upon the documents you and the dealership signed.
