pre-cancellation trip insurance

I purchased travel insurance (that included pre-cancellation) prior to my trip and had to cancel due to a medical reason (travel companion unable to travel due to chemotherapy treatments). Although the insurance company has agreed that the reason that I cancelled was a ''covered'' reason, they refuse to pay because they claim they are only responsible for payment of funds paid to the tour company that they administer claims for and who was to be paid by the travel agent. The travel agent claims she's paid the tour company, but the tour company denied receiving payment. It's been over 90 days and I can't get anyone to reimburse me over $3000 that I paid for a trip that I didn't take!

Without seeing the policy language this seems pretty straight forward. You could always have an attorney put some pressure on them to let them know you are serious, or you could take them to small claims court on your own. It may be the tour company or the travel agent, but if the travel agent paid then I would ask for some sort of receipt or proof of this payment.
