Legal Question in Consumer Law in California
private selling of a car in California
WHAT ARE MY RIGHTS AS THE SELLER IN CALIFORNIA? I sold my college daughter's 1995 Honda Civic for $1200. It was well maintained, registered, smog checked. They test drove it, liked it and bought it. More than 2 weeks has passed and the buyer called talking serious problem. They want their money back. What should I do?

Re: private selling of a car in California
Casual purchases of vehicles are "as is." They had the opportunity to take it to an inspector before they purchased it, I would think. If you knew that the vehicle had no problems and was regularly maintained, then you would have a defense to any lawsuit for fraud. It wouldn't surprise me if the purchaser is not being truthful about why the car has "serious problems."
