Legal Question in Consumer Law in California

I had a flash/zip/thumb drive that went bad. I could not access my files. I sent it back to the manufacturer for repair/replacement. They sent me a replacement that was loaded with another person's personal files on it (including a tax return with names and children's names, places of employment, DOBs, address, SS#s, back acct #s, etc., etc.). I am concerned that the flash drive I returned was fixed and sent to some other person as well with my personal and business private, proprietary, and confidential files on it. Is this not a violation of privacy laws? If so, what action could be taken? Thank you.
