Legal Question in Consumer Law in California
Propane Gas Tank
April, 2006, I had a propane gas tank put onto my property, and gas line run underground to my kitchen for an impending remodel. I filled up the tank with gas and paid a yearly rental fee. One thing has lead to another and I have not been able to proceed with the remodel within the time frame that I had desired. The gas vendor called me and said that they would not renew the rental of the tank and come and pick it up because I was not using the gas. The gas in the tank is bought and paid for, and no mention of usage was discussed at the time of installation. Can they come onto my property, take the tank with the 'paid for' gas in it and not repay me for the unused gas? I am moving forward with the remodel, but I am curious if they can take the tank, with my paid for gas in it with-out compensating me for the gas ($400)? Thank you - M

Do you have a contract with them? If so, read that first. No one can really give you advice without knowing if there is a contract and what it says. If you have one, and you are unclear, feel free to contact my office for a consultation.
