Legal Question in Consumer Law in California

Purchase price of product

I recently purchased a toner product and received a product for a price that was not correctly quoted to me. Upon receipt of the invoice I found that the product was severely overpriced. When calling the company I was told the toner was a high capacity and it is in fact a standard capacity toner. I want to return the product and need to know if I have any legal rights to do so.

Re: Purchase price of product

You can do something legally about this, as this is clearly in violation of PA and I am assuming CA Consumer Fraud Acts, as well as other federal and state laws. However, the cost to go after them will likely make it prohibitive. You can file in your local small claims court, and use your state long arm statute to try to get service, but even if you get a judgement, it will likely be difficult or impossible to collect.

I had a Dr. who is my client that was told he was purchasing a CRATE of toner carts (12) at what he thought was a great price, because he was buying in bulk. But he instead recieved a BOX of 3 carts. So, he grossly overpaid, and was 'screwed'. We spoke about this and he took care of it himself. He had his girls call and order 12 more carts, put them on a credit card, waited 1 day (they ship fast), and called his card company and advised them there was fraud, and they were NOT to pau any future depits to the card from that company. He recieved the 12 additional carts, then recieved a call from the company. He told them he screwed them, how did they like it? They threatened suit, he threatened to call their Sec. of State, and Atty General's office, as well as the authorities in NJ where he was from, as well as the Feds (he rec'd a mail solicitation) as mail fraud is a federal offense. He never heard from them again.

Let your good sense and conscience be your guide.
