Legal Question in Consumer Law in California
we purchase Verizon wireless 4G on Jan 26 2011 with a 2 year contract through a third party "FRY's store". 2 and half weeks after purchasing the device , we decided to return the device so i came back to "FRY's store". At the begining make a purchase, the sales representative told us we can return the device within 30 days. In the paper agreement doesn't say anything about can be return 14 or 30 days. only says early termination up to $175. when we try to return the product, the sales representative refused to receive the device because he said we should to return within 14 days. We said we never heard 14 days return from him (the sales representative) but we only heard about 30 days from him. The sales representative didn't get up to date information about the policy of return of the device. He promise to us giving information about return of the product by email/phone call. He gave me his email and when i sent the email to him about want to return the device, he doesn't mention at all about policy of return the device and delay the answer by email / didn't call me at all so when i come to FRYS to return the device, they refuse again. Because they said out of their responsibility, is already 31 days. We said we try to return the device 2 times since Feb 18. They just want to control the customer and have our money for finish the contract. We called the Verizon customer service tell about our case, and they said just go back to FRYS store and return the device and Verizon will handle about the charge. When we come back to FRYS store, another sales representative said we can't return and will give us a phone call what is his supervisor decision about our case. they didn't call until now. We really upset the way they treat us. We waiting and waiting since Feb 20 for their decision to receive our device back before 30 days. Until now we already start paid the Verizon bill for $86.37.Should I and Can I sue Verizon/FRYS store? I would appreciate any input as to what I should do.

You are really expecting a lot for free, you know?
Read the ocntract. Everything will be determnined by what is in the written contract when you bought the phone.
