Legal Question in Consumer Law in California
We purchased a new car from the dealership on Aug. 22 and signed the contract we were told they already had it approved and it was a done deal. The car was ours. The contract does not have a stipulation on it saying the deal was pending approval. The box marked sellers right to cancel has N/A in that section. We paid them 2500 down and 500 trade in and we had another payment of 1500 due on the the 15th of Sept. and our 1st payment was due on the 6th of Oct. Which we paid to Saturn of Roseville on the 1st of Oct. we sent the check to them because they were listed on the top of the contract as the creditor. We have done everything according to the contract. We were not told anything about the deal not being done. After accepting all of our money they came and took the car in the middle of the night on Oct 9th leaving us without any means of transportation. When I called to see why they came and took it, they said they had the right to take it because we would not agree to bring it back and they couldn't get financing for us that we could come and get our trade in back and our money except that they were going to charge us for having to come and get it.
