Legal Question in Consumer Law in California

purchased a defected water heater

Two years ago, We purchased a new $900.00 water heater from a company. 2 months ago the burner went out and so we called the company we got it from, they sent someone out and basically the employee questioned us on where we bought the water heater from, when we told him from his company,he said that it was '' a crappy water heater and they dont last long'' well he installed a new burner & we were charged $180.00. now just today the burner is out again we called the same company, a diffrent guy came out, and told us the burner is out and we have to call the manufactor for the burner because its still under warranty. This guy also told us the same thing the first guy told us and he said we were better off buying a new one. and this guy said he didnt know why we were charged 180.00 in the first place when it was still under warranty. My question is can i get my $900.00 back that i spent on the ''crappy water heater'' and the $180.00 that i was charged for them replacing the burner, if it was still under warranty. When i called the company and complained they said there was nothing they can do for us. And told me to call the manufactor . I just want my money back . Is it worth fighting for?

Re: purchased a defected water heater

You can probably get the $180 back if it was under warranty. But why would they owe you the $900? You bought it. It may not be great, but that was your decision. Sorry.

Call the manufacturer about the warranty and talk to them about the $180. If they cannot help you, send a letter to the company demanding the $180 back (assuming it was a warranty repair). If that doesnt work, file in small claims court.
