Legal Question in Consumer Law in California

Question about Breaking a Contract

I signed a contract earlier this year to attend 48 weeks (spread out over 2 years) of a writing class. Total cost of the program is $7,700. I have paid $1900 of the total. This month I am moving out of the area for a job and taking a 55% pay cut, making the $150 monthly payments (then $200, then $250 in subsequent years.) impossible to keep up with.

I want to stop taking classes - program insists they can't break contract but suggested I submit a proposal with an early termination fee... What do you suggest? What is a fair percentage to pay out? Do I have any other options?

Re: Question about Breaking a Contract

Do you have a written contact? If so, what does it say about termination? If you don't have a contract, I think it would be difficult for them to insist on anything. If you do have a contract and it's silent as to termination, I would make the argument that the $7700 should be prorated on some favorable basis.
