Legal Question in Consumer Law in California
rebate that never came
About a year ago, I bought a laptop at Best Buy with a promise of $400 in rebates. However, the rebates never came and I was told repeatedly over the phone by the company reps that the checks were cashed and there was nothing else they can do for me. I must have called in at least 5 times and every consecutive time, I was put on hold for a longer amount of time, up to 1 hour and half. I was wondering if there's anything I can do about this. Doesn't the company have a responsibility if their checks are cashed by the wrong person?

Re: rebate that never came
A lot of companies will play the delay game or the blame game in the hopes that the rebate claimant will give up and go away. If they sent the rebate checks to you and someone stole your mail, that's not their fault. If they sent the checks to the wrong place, that is their problem. Until, you've had to take their word for it.
I would spend the $20 bucks and file a small claims action. Chances are they will settle with you before the hearing.
