Legal Question in Consumer Law in California
refund of expense account
My daughter played for a girls fastpitch travel team. These teams incur expenses, so at the 1st team meeting they wanted to collect from the parents to cover their daughters expenses. We provided $350 to pay for uniforms, tournaments and misc. expenses. We also did team fundraisers that brought our credit to $500. The tresurer for the team details every girls credits and debits and notifies the parents. My daughter quit the team after 3 months with a balance of $194 in her account and she was also debited $50 for 2 tournaments she didn't play in because she already left the team. They were prepaid before she left the team. There wasn't any contract signed and in no way was the money we provided a gift or sponsorship for their program. It is only provided for them to pay for her expenses. Since she is no longer on the team I want my money back. They are refusing to give any of it back. I think all fundraiser money should be debited first in case you have money not used you can reimberse the parents. I am sueing them in small claims court. What do you think the outcome will be and do you have any advise on how I should present my case. Thx
