Legal Question in Consumer Law in California

Refund policy

I am currently relocating from Los Angeles, California to Houston, Texas. I solicited the help of an auto transport company to help with the transportation of my vehicle. The timeframe of delivery that they quoted me was different from what their contracted driver proposed to me so I decided that I would no longer need their services. When I had given the company the deposit for the pickup I was not told that it was non-refundable. However when I called to cancel the pick up the company said that it was non refundable and that it was stated on the website. I never signed or read any terms and conditions that was posted on the wedsite so I believe that I am entitled to my refund.

Re: Refund policy

You may very well be entitled to a refund. If the transport company is based in California, and it is under $7,500, file in small claims court. If they are out of California or it is more than $7,500, you need to file in Superior Court, probably limited jurisdiction.

If you elect small claims court, email me at [email protected] for a copy of my free book on small claims court.
