Legal Question in Consumer Law in California
Rental truck break-down
I rented a truck from a well-known nation-wide company. The truck broke down twice within four hours, the second time being at a gas station within 100 yards of the truck depot.
I told the guys at the depot that it had broken down, but they gave no assistance. I phoned the breakdown hotline, explained what was wrong, and gave the location of the truck. Before the breakdown assistance arrived, the truck was towed away at the request of the gas station.
The truck rental company is now holding me liable for the towing/release fees. I have argued that it is their responsibility as the breakdown was due to the truck being defective.
So my question is, if they sue me for payment, what do I do? And what are my chances?

your rights and obligations are defined by the rental contract.
