Legal Question in Consumer Law in California
Repossed Auto Sale Notification
My auto was repossed and I was sent a ''Notice of Plan To Sell.'' It states that it would be sold ''at a private sale after August 19.'' I was not notified as to the date, time and place of sale. In October I was sent a deficiency notice from this sale. Was the procedure defective without allowing me a chance to be present and bid?

Re: Repossed Auto Sale Notification
Notice of acutal date of sale is not required. However, the sale cannot be private, it must be open to obtain the best price. You should consult an attorney ASAP
