Legal Question in Consumer Law in California
Who is responsible & how do I hold them accountable?
I sent 2 watches in to the ''authorized''(not owned by '''', but posted on their website) service center registered & insured.
Soon after receiving an estimate, my husband was let go from his job& we moved. After receiving another estimate at my new address (mail was delayed), I contacted the watch co. to proceed w/ repairs. They informed me that they had already sent the watches back (w/out any notification or consent from me)to my previous address & that proof of delivery slip showed my signature. They told me that they were not going to take responsibility & I must contact FedEx & take it up with them which I did. FedEx also claims it's not their responsibility but that it is clearly a case of theft & forgery by the person that accepted the package & I should contact the police dept. I sent the Polce Dept. a detailed report as they asked & I requested to file against the homeowners of the residence where the package was signed for & received. We called the homeowner at the chance that they signed for the package & were unable to reach us to return it. They denied having signed for it and/or any knowledge of the delivery. Watch co will not talk to us. What can we do & who is responsible?

Re: Who is responsible & how do I hold them accountable?
If the value of the watch is under $5000, then you can and should sue all of the parties in Small claims court. If more than $5000, then you may need an attorney.
