Legal Question in Consumer Law in California
responsible party
My gym has been taking my membership fees from my bank account AND billing my credit card. I didn't know I had an old membership that I was still paying for when I rejoined under another FIRST name. (Marilyn vs. Lynne) same last name. I paid double for over 2 years. They say it's my fault. Is it totally or do they share some responsibility? What recourse do I have? What laws are in my favor that I can use in negotiations?

I would ask them to credit your membership payments for future months to equal the amount you overpaid, if they value your membership. If not, take your business elsewhere.
As an aside, it's always wise to regularly review your bank and credit card statements. It's amazing what charges might sometimes pop up on them.
