Legal Question in Consumer Law in California
Rights and Prodecure To Canel Cell Phone Contract
Hello. I have signed up for a 1 year contract for 2 cellular phones on the same account. After comparing my bill to the contract I noticed that on one phone, they are charging me for a voicemail service that was supposed to be free on the contract. On the other phone, they were charging me additional service for 1000 off-peak minutes which should be included with the service. They are now crediting me the charge for 100 off-peak minutes on a month to month basis, but not the voicemail charges. Is this not a breach of contract? This is my main reason for wanting to cancel my service with them.
I have sent a letter to the company explaining my situation and they replied:
1. my contract is a 2-year contract (2001 to 2003)
2. i will still be responsible for the early termination charges for both phones.
thank you

dont pay the extra charges. if they cancel you for that reason you have a defense if they try to collect the cancelation fee.
