Legal Question in Consumer Law in California

Seller of a vehicle

On Friday, I accepted a $200 down payment towards the sale of my vehicle. I signed a hand written form saying that i will deliver the vehicle on March 8, 2003, then accept the remaining $1,600. I would like to extend the deliver date to 3/14/03 however the buyer does not want to compile. Can I cancel the sale.

Re: Seller of a vehicle

Because of your contract, the buyer has a right to pay the balance and acquire possession and title on 3/8. If you fail to perform, you will be in breach.

Problems like these are best solved by being creative and cooperative.

Ask if he'll allow your late delivery if you reduce the price by $100 or so. Whatever your arrangement, draw it up and sign it.

I'm sure there's a solution somewhere, work it out.

Not really. You have to deliver and he has to pay. If he does not pay, you have the car.
