Legal Question in Consumer Law in California

Shipping and Handling

I recently cancelled services from

AT&T because they were incapable of

providing internet service for my

home. They have credited

everything except for shipping and

handling charges and sales tax. They

have not provided service so I feel

that they should not receive

payment. Is it legal to charge for

these services when they have not

provided the fundamental service?

Re: Shipping and Handling

I suggest that you call them, explain the situation, ask them why they are charging these charges, and ask for a credit/refund.

Based on the limited facts, it may be a breach of their contract to charge you anything. Their position may be that they elected to provide a refund as a courtesy to you and are not admitting that the services were not provided.

This is an interesting issue. I have the following questions for you:

How much were the unrefunded charges?

What exactly did they charge you for?

Shipping of what?

Handling of what?

Did they provide ANY internet services?

Did you they provide LOUSY internet services?

How long was your account open?

Feel free to email me if you get the answers or wish to discuss.

Good luck!
