Legal Question in Consumer Law in California

Signed New Car Contract

I bought a car and signed the contract and I'm waiting for the delivery due to color choice. The dealership contacted me with a number error and they want an additional 2500 dollars. I said no because I signed the contract for XXX amount of dollars. They said the contract was void because I haven't taken delivery of the vehicle but it has not been delivered yet to the dealership. So, do I get the vehicle at the contract price or can they call the contract null and void?

Re: Signed New Car Contract

It depends upon what the contract says. I would not be surprised to see a clause in the contract that permits the dealer to revise their numbers due to mistakes. That provision could also provide that in the event the purchaser refuses to pay any additional amounts, the contract becomes null and void and of no force or effect.

Look at your contract to see what it says. If you can't figure it out, set up an appointment with an attorney in your area and ask them to look at the contract.
