Small Claims Court - Defendent Lives Out Of State
I purchased a bicycle from a person over the internet. I live in California and the seller lives in Texas. The description stated that there were certain parts on the bicycle and so did a written, signed bill of sale. I have copies of the bill of sale, my check, and the original add placed by the seller. When I received the bicycle I found that it did not have the parts as described. I would like to take this to small claims court. Is it possible for me to do this? If it is, what happens if the seller does not appear in court?
