Legal Question in Consumer Law in California
Should we go to small claims court?
My son took his van to a guy who just opened his repair shop & said he'd repair van in one week for half the cost other businesses quoted ($500). He had van for over 3 weeks and it ended up costing $1,000. Van worse than before repairs so son goes back and asks the guy to fix it or refund the money. Fellow gets mad and throws my son to ground in a head lock. Witnesses gave my son their cards. My son calls Police and they tell him his only option is to do a citizens' arrest. What should he do?

The repair shop had to provide a written estimate before starting work, pursuant to California law. Did they? Rather than small claims, I would look for a personal injury attorney to handle a claim for civil assault against the attacker.

the police are correct. follow their advice and then go to small claims court.
